Disciplinary Processes

The purpose of discipline is to change behaviour, if behaviour does not change a formal process is required to terminate employment. Failure to do so increase the risk of penalties for nonadherence to the Labour Relations Act. Labore is part of the South African United Employers Organisation and as such able to assist employers to become members, and to support in all disciplinary matters and represent the employer at the CCMA. The disciplinary procedure and code with all pro-forma documents can be provided was part of, or independently from the HR policies and Procedures.

Incapacity terminations

In the event of medical incapacity, the Labour Relations Act requires a specific process to be followed to ensure that employees and employers are treated in a fair manner. We advise employers and facilitate the required process on behalf of our clients.

Poor performance terminations

The Poor performance management process is prescribed by law and is quite detailed. Labore will guide you through the process to ensure compliance with employment legislation.

Retrenchments

Termination for Operational Requirements or as it is more commonly referred to, Retrenchment, requires different procedures in different environments, depending on number of employees affected, membership of Trade Unions or Bargaining Councils. Besides the correct procedures there are legal requirements for selecting employees for retrenchment and calculation of the amounts due to such employees. Labore assist in facilitation the complete process on behalf of our clients.
